Terms and Conditions

These Terms & Conditions ("Terms") govern your use of the website, booking services, massage therapy services, wellness services, studio services, mobile services, memberships, and other services offered or coordinated by REST Network LLC, doing business as REST ("REST," "we," "our," or "us").

By accessing our website, creating an account, booking an appointment, purchasing a service or membership, or otherwise using our services, you acknowledge that you have read, understand, and agree to these Terms.

If you do not agree to these Terms, you should not use our website or book or receive services from REST.

REST may update these Terms from time to time. The version in effect at the time of your booking will apply to that booking unless otherwise required by law.

1. SERVICES COVERED BY THESE TERMS

REST provides and coordinates massage therapy and wellness services through licensed or otherwise appropriately credentialed massage therapists, wellness professionals, and, where applicable, Healthcare Providers.

Services may be provided at REST studio locations, at a client's requested location, or at another approved location.

For purposes of these Terms:

"Mobile Services" means massage therapy or wellness services provided at a client's residence, hotel, workplace, assisted living facility, nursing facility, event venue, or other approved location outside a REST studio.

"Studio Services" means massage therapy or wellness services provided at a REST-operated, REST-managed, or otherwise approved REST service location identified during the booking process.

"Provider" means a massage therapist, wellness professional, Healthcare Provider, or other professional who provides services booked or coordinated through REST.

REST may offer different services, appointment lengths, pricing, availability, and Providers depending on location.

2. ELIGIBILITY AND BOOKING

You must be at least eighteen (18) years old to enter into a booking agreement with REST unless a parent or legal guardian is booking on behalf of a minor.

If you make a booking for another person, you represent that you are authorized to make the booking and provide information on that person's behalf.

You are responsible for providing accurate and complete information during the booking process, including the name of the person receiving services, contact information, service address when applicable, health information, access instructions, and any other information reasonably requested by REST.

REST may decline, cancel, or refuse a booking when information provided is inaccurate, incomplete, fraudulent, or creates a safety concern.

3. PAYMENT

Payment is due at the time of booking for both Mobile Services and Studio Services unless REST expressly agrees otherwise in writing.

An appointment is not considered fully booked or confirmed until all required booking information and payment have been received.

You authorize REST and its payment processors to charge the payment method you provide for the service price and any applicable fees, taxes, cancellation charges, no-show charges, membership charges, or other amounts authorized under these Terms or disclosed at the time of booking.

Prices may vary based on service type, duration, location, time, Provider, special request, or other booking factors.

REST may change its prices at any time. Price changes will not alter the price of an appointment that has already been fully booked and paid unless the booking itself is later modified.

4. CANCELLATION POLICY

All appointments are also subject to REST's separate Cancellation Policy, which is incorporated into these Terms by reference.

Clients are responsible for reviewing the Cancellation Policy before booking.

REST currently applies a cancellation charge to same-day cancellations as stated in the Cancellation Policy presented during the booking process.

If the Cancellation Policy shown at the time of booking differs from information elsewhere on the website, the policy expressly presented and agreed to as part of that booking will control.

5. NO-SHOWS

Failure to appear for a scheduled appointment without properly canceling is considered a no-show.

No-shows are charged 100% of the scheduled service fee and are nonrefundable.

For Mobile Services, an appointment may also be treated as a no-show when the Provider arrives at the confirmed location but is unable to contact the client, gain access to the property, or begin the appointment because the client is unavailable.

6. LATE ARRIVALS AND DELAYS

Appointments are reserved for a specific period of time.

If you arrive late to a Studio Service, your appointment will still end at the originally scheduled ending time unless REST is able and agrees to extend the appointment.

The full service price remains due when an appointment is shortened because of client lateness.

For Mobile Services, the client is responsible for providing accurate access information, including apartment numbers, gate codes, parking information, hotel room information where appropriate, building instructions, and other details reasonably necessary for the Provider to access the appointment location.

Delays caused by missing or inaccurate access information, difficulty contacting the client, parking delays resulting from client instructions, or other client-related access issues do not extend the scheduled appointment.

The appointment will still end at its originally scheduled time unless the Provider is able and agrees to extend it.

7. MOBILE SERVICES

Clients receiving Mobile Services agree to provide a reasonably safe, clean, and appropriate environment for the Provider to perform the scheduled service.

The client is responsible for ensuring that the service location has sufficient space for the Provider and any required equipment.

The Provider may decline to enter or may leave a location if the Provider reasonably believes that the environment is unsafe, threatening, unsanitary, inappropriate, or otherwise unsuitable for the service.

Mobile Services may be affected by circumstances outside REST's control, including weather, traffic, road closures, building access restrictions, parking conditions, or emergencies.

REST will make reasonable efforts to communicate material delays or changes.

8. STUDIO SERVICES

Studio Services are provided at the location identified in your booking confirmation.

Clients are responsible for reviewing the appointment address before arriving.

REST may operate or provide services from multiple locations, and the specific location listed in your confirmation controls for your appointment.

Clients must comply with reasonable studio, property, building, parking, security, and access rules.

REST may change treatment rooms, Providers, or other operational details when reasonably necessary as long as the scheduled service can still be appropriately provided.

9. PROVIDER ASSIGNMENTS AND CHANGES

REST may assign a Provider based on availability, location, qualifications, requested service, and other operational considerations.

Clients may request a male or female Provider when that option is available.

Gender requests are treated as preferences and are subject to availability unless REST has specifically confirmed that request.

If the originally assigned Provider becomes unavailable, REST may substitute another appropriately qualified Provider.

If REST cannot provide the scheduled service and no acceptable substitute or rescheduling option is available, REST may cancel the appointment and provide an appropriate refund or credit for the affected service.

10. THERAPEUTIC NATURE OF SERVICES

All massage therapy and bodywork provided through REST are professional and therapeutic in nature.

REST has a zero-tolerance policy for sexual requests, sexual behavior, inappropriate touching, harassment, threatening conduct, abusive language, or other behavior that makes a Provider reasonably feel unsafe or uncomfortable.

A Provider may immediately stop or refuse a service if inappropriate or unsafe conduct occurs.

If a service is ended because of a client's inappropriate, sexual, threatening, abusive, or unsafe conduct, the appointment will be considered completed for billing purposes and no refund will be provided.

REST may refuse future services to any client who violates this policy.

11. HEALTH INFORMATION AND CLIENT RESPONSIBILITY

Massage therapy and wellness services are not substitutes for diagnosis, medical treatment, emergency care, or advice from a physician or other qualified Healthcare Provider.

Clients are responsible for providing accurate and complete information regarding relevant medical conditions, injuries, medications, pregnancy, surgeries, allergies, physical limitations, or other health concerns that may affect the safety or appropriateness of a service.

Clients should consult their physician or other Healthcare Provider if they are uncertain whether massage therapy or another REST service is appropriate for them.

REST and its Providers may modify, postpone, or decline a service when the Provider believes that performing the service could be unsafe, inappropriate, outside the Provider's scope of practice, or otherwise contraindicated.

If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency medical care.

12. PREGNANCY

Prenatal massage may be subject to additional service requirements, intake procedures, positioning, modifications, or restrictions.

Unless otherwise approved under REST's applicable prenatal service procedures, REST does not provide prenatal massage during the first trimester of pregnancy.

Clients are responsible for accurately disclosing pregnancy when booking and during the intake process.

13. SPECIALIZED SERVICES

REST may offer specialized services including, but not limited to, prenatal massage, postpartum massage, oncology massage, post-operative massage, cupping, stretching, pain-management services, services for older adults, and other specialized wellness services.

Certain services may not be appropriate for every client.

Providers may modify techniques, pressure, positioning, duration, or treatment areas based on the client's condition, comfort, safety, professional judgment, or scope of practice.

Booking a specific service does not guarantee that every advertised technique will be appropriate or performed during every appointment.

14. CLIENT CONSENT AND COMMUNICATION DURING SERVICES

Clients are encouraged to communicate openly with their Provider regarding pressure, positioning, temperature, comfort, treatment areas, pain, or any other concern.

A client may request that pressure be modified or that work on a particular area stop at any time.

The Provider may also modify or discontinue a technique when the Provider determines that continuing would not be appropriate.

Clients retain the right to end a session at any time. Ending a session early at the client's request does not automatically entitle the client to a full or partial refund.

15. DRAPING AND PROFESSIONAL BOUNDARIES

Professional draping standards will be used when appropriate for the service provided.

Only the area actively being treated will be uncovered as reasonably necessary.

Clients are expected to follow Provider instructions concerning clothing, draping, positioning, and professional boundaries.

REST Providers will not perform massage or bodywork involving sexual activity or inappropriate contact.

16. MINORS

Massage therapy services for minors are subject to applicable law and REST policies.

A parent or legal guardian must provide any consent required by law before REST provides massage therapy services to a minor.

REST may impose age restrictions or additional requirements for services provided to minors.

REST may also require a parent or legal guardian to remain present at the service location or in the treatment room depending on the client's age, the service provided, applicable law, or REST policy.

REST may decline to provide a particular service to a minor when REST or the Provider determines that the service is not appropriate.

17. REFUNDS

Except where otherwise required by law or expressly stated in REST's Cancellation Policy, completed services are final and nonrefundable.

A client's dissatisfaction with personal preferences regarding pressure, technique, Provider style, or similar subjective aspects of a completed service does not automatically entitle the client to a refund.

REST may, in its sole discretion and where appropriate, issue a refund, partial refund, credit, complimentary service, or other accommodation.

Nothing in this section limits any rights that cannot legally be waived.

18. MEMBERSHIPS

REST may offer recurring memberships or membership programs.

Membership pricing, included services, billing frequency, usage restrictions, renewal terms, cancellation procedures, and any other membership-specific conditions will be presented during enrollment or in the applicable membership agreement.

By enrolling in a recurring membership, you authorize REST to charge the payment method on file according to the billing schedule presented at enrollment until the membership is canceled in accordance with the applicable membership terms.

Unused membership benefits, credits, or sessions are subject to the specific terms of the membership purchased.

Membership benefits may not be combined with other promotions or discounts unless expressly permitted.

If separate membership terms conflict with these general Terms, the membership-specific terms will control with respect to the membership.

19. GIFT CARDS, PACKAGES, CREDITS, AND PROMOTIONS

REST may offer gift cards, prepaid packages, account credits, discounts, promotional offers, or other incentives.

Additional conditions may apply to individual promotions, packages, or gift cards and will be disclosed at the time of purchase or offer.

Promotional offers may have expiration dates, eligibility requirements, location limitations, service limitations, or other restrictions to the extent permitted by law.

Cash redemption and expiration of gift cards or similar stored-value products will be handled in accordance with applicable law.

Promotional discounts generally cannot be combined unless REST expressly states otherwise.

20. GRATUITY

Gratuity is optional unless a particular booking, event, group service, or agreement expressly states that gratuity or a service charge is included or required.

When gratuity is optional, clients may tip their Provider at their discretion.

Any mandatory service charge or gratuity will be disclosed before payment when applicable.

21. CORPORATE, GROUP, AND EVENT SERVICES

Corporate massage, chair massage, wellness events, group bookings, private events, and similar services may be subject to a separate proposal, invoice, event agreement, deposit requirement, cancellation policy, attendance requirement, or other written terms.

If separate event-specific terms conflict with these Terms, the event-specific written agreement will control with respect to that booking.

22. SERVICE AVAILABILITY

REST does not guarantee that any particular Provider, service, appointment time, service area, or location will always be available.

REST may change operating hours, service areas, studio locations, Provider availability, offered services, or booking procedures at any time.

Availability shown online is subject to confirmation and may change because of Provider availability or operational circumstances.

23. REFUSAL OR TERMINATION OF SERVICE

REST reserves the right, to the extent permitted by law, to refuse, suspend, or terminate services or future bookings for reasons including:

  • inappropriate or sexual conduct;

  • threatening, abusive, harassing, or discriminatory behavior;

  • repeated no-shows;

  • fraudulent payment activity;

  • chargeback abuse;

  • failure to follow reasonable safety requirements;

  • unsafe appointment environments;

  • violations of these Terms;

  • conduct that places a Provider, employee, client, or another person at risk; or

  • other circumstances in which REST reasonably determines that continuing the client relationship is inappropriate.

REST may also terminate or restrict a client's access to online booking where appropriate.

24. PROVIDER SAFETY

Provider safety is a condition of every booking.

A Provider may leave or refuse to enter an appointment location if the Provider reasonably perceives a threat to personal safety or encounters unsafe conditions.

REST may contact the client, building staff, emergency personnel, law enforcement, or other appropriate parties when reasonably necessary to protect the Provider or others.

25. PERSONAL PROPERTY

Clients are responsible for their personal belongings before, during, and after appointments.

To the fullest extent permitted by law, REST is not responsible for lost, stolen, misplaced, or damaged personal property unless the loss or damage results directly from conduct for which liability cannot legally be excluded.

Clients may be held responsible for damage they intentionally or negligently cause to REST property, equipment, studio property, or Provider equipment.

26. WEBSITE AND ACCOUNT USE

You may use restmassage.net and REST's booking systems only for lawful purposes.

You may not attempt to interfere with the operation or security of the website, gain unauthorized access to accounts or systems, introduce malicious software, scrape or copy protected content using unauthorized automated methods, impersonate another person, or use the website for fraudulent or unlawful activity.

You are responsible for maintaining the confidentiality of any account login information associated with your REST account.

You must notify REST if you believe your account or payment information has been compromised.

27. INTELLECTUAL PROPERTY

The REST name, website, logos, designs, text, photographs, graphics, branding, service descriptions, and other original content made available by REST are owned by REST Network LLC or used with permission.

You may not reproduce, distribute, commercially exploit, modify, or use REST's protected content without prior written permission except as permitted by law.

28. ELECTRONIC COMMUNICATIONS

By booking or using REST services, you agree that REST may contact you electronically regarding your appointment, account, payment, service changes, confirmations, reminders, cancellations, customer service matters, or other transactional information.

Communications may include email, telephone calls, and text messages.

Message and data rates may apply depending on your carrier.

Transactional communications related to an appointment or account are separate from marketing communications.

Where required by law, REST will obtain any separate consent necessary for promotional or marketing text messages or emails.

You may opt out of marketing communications using the method provided in the communication.

Opting out of marketing communications does not prevent REST from sending transactional messages that are reasonably necessary to manage an existing booking, payment, or account.

29. THIRD-PARTY SERVICES

REST may use third-party services to operate its website, process payments, manage scheduling, send communications, provide maps, host content, or support other business functions.

REST is not responsible for the independent acts, omissions, privacy practices, or systems of third-party service providers except to the extent required by applicable law.

Links to third-party websites do not constitute an endorsement by REST.

30. HEALTH AND MEDICAL DISCLAIMER

REST does not diagnose medical conditions or prescribe medical treatment unless such services are expressly being provided by an appropriately licensed Healthcare Provider acting within that Provider's lawful scope of practice.

Massage therapy and wellness services may involve inherent risks, including temporary soreness, bruising, tenderness, aggravation of an existing condition, dizziness, discomfort, or other physical responses.

By voluntarily receiving services, you acknowledge that these risks may exist.

You agree to communicate promptly with your Provider if you experience pain, numbness, dizziness, discomfort, or any other concerning symptom during the session.

31. ASSUMPTION OF RISK

To the fullest extent permitted by law, you voluntarily assume the ordinary and reasonably foreseeable risks associated with receiving massage therapy or wellness services.

You remain responsible for deciding whether a service is appropriate for you and for providing accurate information to assist your Provider in making appropriate treatment decisions.

Nothing in these Terms is intended to waive liability that cannot legally be waived.

32. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, REST's website and services are provided on an "as available" and "as is" basis.

REST does not guarantee any particular therapeutic, medical, wellness, pain-relief, recovery, mobility, or other outcome.

Individual responses to massage therapy and wellness services vary.

REST does not warrant that the website will always operate without interruption, delay, error, or technical problem.

Nothing in these Terms excludes any warranty or legal protection that cannot lawfully be excluded.

33. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, REST Network LLC and its owners, officers, employees, contractors, Providers, affiliates, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of REST's website or services.

REST will not be responsible for damages resulting from inaccurate or incomplete information supplied by the client, failure to follow reasonable Provider instructions, undisclosed health conditions, or circumstances outside REST's reasonable control.

Nothing in these Terms limits or excludes liability to the extent such limitation or exclusion is prohibited by applicable law.

34. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless REST Network LLC and its owners, officers, employees, affiliates, representatives, and Providers from claims, losses, damages, liabilities, or reasonable expenses arising from:

  1. your material violation of these Terms;

  2. fraudulent or unlawful use of REST's website or services;

  3. false, incomplete, or misleading information you knowingly provide;

  4. unsafe conditions at a location under your control; or

  5. claims arising from conduct by a guest or other individual for whom you made the booking.

This provision does not require you to indemnify REST for liability that applicable law does not permit REST to shift to you.

35. FORCE MAJEURE

REST will not be responsible for delays, interruptions, cancellations, or inability to perform caused by circumstances beyond its reasonable control.

Such circumstances may include severe weather, hurricanes, flooding, natural disasters, power outages, road closures, transportation disruptions, government actions, public health emergencies, civil disturbances, building closures, infrastructure failures, or other comparable events.

REST will make reasonable efforts to communicate affected appointment changes and determine an appropriate rescheduling, credit, or refund when applicable.

36. CHARGEBACKS AND PAYMENT DISPUTES

Clients are encouraged to contact REST promptly regarding billing concerns so REST has an opportunity to review and resolve the matter.

Initiating a payment dispute or chargeback does not automatically eliminate a valid payment obligation.

REST may provide payment processors or financial institutions with booking confirmations, cancellation acknowledgments, service records, communications, signed policies, or other relevant documentation in response to a payment dispute.

Fraudulent or abusive chargebacks may result in restriction of future services.

37. PRIVACY

REST's collection, use, storage, and handling of personal information is governed by REST's Privacy Policy.

By using REST's website or services, you acknowledge that you have access to the Privacy Policy and understand that information may be processed as reasonably necessary to manage bookings, payments, communications, client records, and services.

38. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

If Services are provided to you in another state, any non-waivable consumer protection, professional licensing, health and safety, or other mandatory laws of that state will continue to apply to the extent required by law.

Nothing in these Terms is intended to eliminate legal rights that cannot lawfully be waived.

39. DISPUTES

Before filing a formal legal claim arising from a REST service, booking, payment, or these Terms, you are encouraged to contact REST and provide a reasonable opportunity for the matter to be reviewed and resolved informally.

Nothing in this section prevents either party from exercising a legal right or remedy available under applicable law.

These Terms do not require arbitration unless REST and the client separately enter into a valid written arbitration agreement.

40. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, when necessary, severed from these Terms.

The remaining provisions will remain in effect.

41. NO WAIVER

REST's failure to enforce any provision of these Terms on one occasion does not waive REST's right to enforce that provision or any other provision in the future.

42. ASSIGNMENT

You may not transfer your rights or obligations under these Terms to another person without REST's written consent.

REST may assign or transfer its rights or obligations in connection with a merger, acquisition, sale, restructuring, change of ownership, or other lawful business transaction.

43. ENTIRE AGREEMENT

These Terms, together with REST's Privacy Policy, Cancellation Policy, applicable membership terms, intake and consent forms, and any other service-specific agreement accepted by you, constitute the applicable agreement between you and REST regarding the services covered by those documents.

If a service-specific written agreement, membership agreement, event agreement, or other booking-specific policy conflicts with these general Terms, the more specific agreement will control with respect to that particular service.

44. CHANGES TO THESE TERMS

REST may revise these Terms from time to time to reflect changes in services, business operations, policies, technology, or applicable law.

Material changes will apply prospectively unless otherwise permitted or required by law.

The effective date shown at the top of these Terms identifies the most recent version.

Continued use of REST services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
